11. Liability
a. We ensure that McPADDEN Products are made with reasonable care and skill, aiming to meet our specifications. However, we cannot guarantee they will meet your specific needs.
b. Our liability is strictly limited to what is stated in this Agreement. We are not responsible for any other claims, whether in contract, negligence, or any other legal basis.
c. We do not exclude or limit our liability for death or personal injury caused by our negligence.
d. Subject to section f below, we are only responsible for direct losses or damages, whether caused by us, our employees, agents, or subcontractors. Our total liability for any McPADDEN Product will be the greater of:
i. £10 (ten pounds), or
ii. The price you paid for the product.
e. We are not responsible for:
i. Loss of revenue, business, anticipated savings, or profits.
ii. Any indirect, special, or consequential losses, whether due to delays, non-delivery, or any other reason.
f. Unless specifically stated elsewhere in this Agreement, we do not make any other warranties or guarantees, except in cases of fraud or where the law requires them.
These liability terms remain in effect even if this Agreement ends.
12. Entire Agreement
This Agreement is the complete and final agreement between you and us regarding the McPADDEN site and products. It replaces any previous agreements or understandings, except in cases of fraud.
Only parties to this Agreement have rights under it—third parties cannot enforce any terms under the Contracts (Rights of Third Parties) Act 1999.
13. Changes to This Agreement
We may update this Agreement from time to time. Any new version will take effect once it is posted on the McPADDEN website.
14. Invalidity
If any part of this Agreement is found to be invalid or unenforceable, the rest of the Agreement will still remain in effect.
15. Governing Law
This Agreement and all purchases of McPADDEN Products are governed by Irish law.
